What Happened
The Haryana Real Estate Regulatory Authority (HARERA) has ordered Ramprastha Promoters & Developers Pvt. Ltd. to pay ₹50 Lakh in compensation, along with 11% annual interest, to a homebuyer who has waited close to 13 years for possession of his apartment in Ramprastha City The Edge Towers, a residential project in Sector 37D, Gurugram.
According to the case details, the complainant — Vinod Kumar Gupta — booked the unit back in 2010 for approximately ₹49.8 Lakh. Under the builder-buyer agreement, the developer was contractually bound to hand over possession by August 31, 2012. Instead, the project dragged on for over a decade beyond that date, leaving the buyer without a home despite having paid for it in full over a decade ago.

WhatsApp UsWhy Compensation, Not Just Interest
Under Section 18 of the RERA Act, 2016, a homebuyer whose possession is delayed beyond the agreed date has two broad options: withdraw from the project and claim a full refund with interest, or continue with the project and claim interest for every month of delay until possession is actually handed over. In cases of prolonged and unreasonable delay — as in this 13-year gap — regulatory authorities like HARERA also have the discretion to award additional monetary compensation on top of the standard delay interest, recognising the real financial and personal cost a buyer bears over such an extended wait.
What to Do If Your Own Possession Is Delayed
If you're a buyer currently waiting past your promised possession date, here's the practical sequence most RERA complaints in Haryana follow:
- Check the builder-buyer agreement for the exact promised possession date and any grace period clause.
- Verify the project's RERA registration status and current extension on haryanarera.gov.in — a registered project's quarterly progress reports will show how far construction has actually progressed.
- Calculate the delay period in months from the promised date to today, since interest and compensation claims are typically computed against this.
- Send a written notice to the developer referencing the agreement clause and delay, before escalating.
- File a complaint with HARERA (Gurugram bench for Gurugram projects) via haryanarera.gov.in, attaching the agreement, payment receipts, and correspondence.
- Decide your relief: refund with interest and exit, or continue with the project and claim delay compensation/interest — HARERA will consider either based on your complaint.
